These Terms of Sale ("Terms") govern your purchase of hardware products from the Kaleidescape Product Store. By placing an order, you agree to these Terms.

These Terms are in addition to the Kaleidescape Service and License Agreement ("SLA") available at https://www.kaleidescape.com/legal/sla/ which governs your use of Kaleidescape systems, software, and services. In the event of a conflict between these Terms and the SLA, these Terms control with respect to Product Store purchases.

1. Eligibility and Geographic Restrictions

To purchase, you must provide a U.S. billing address; pay with a U.S.-issued credit card in USD; and ship to a U.S. address that matches your billing address.

2. Products and Pricing

All product descriptions, specifications, and pricing are subject to change without notice. We make reasonable efforts to ensure accuracy but do not warrant that product descriptions, pricing, or other content is error-free. Prices displayed are in U.S. dollars and do not include applicable taxes, which will be calculated at checkout.

3. Product Compatibility

You acknowledge that certain products require additional hardware or system configurations to function as described on the product pages. For example, Kaleidescape servers require a Strato Movie Player to play movies, and systems are limited to a maximum of four servers. Review product requirements carefully before purchasing.

4. Orders and Acceptance

Your submission of an order constitutes an offer to purchase. Order confirmation does not constitute acceptance. We reserve the right to accept or decline any order, in whole or in part, for any reason, including pricing errors, product availability, suspected fraud, or other order irregularities. A binding contract is formed only when your order ships and your payment is captured.

5. Payment

We accept Visa, MasterCard, and American Express. For security purposes, CVV is required for all hardware purchases, even for payment methods already on file. When you place an order, your credit card will be authorized for the full order amount. The charge will be captured when your order ships. If payment capture fails, we will contact you before releasing the shipment.

6. Shipping and Delivery

Orders are shipped using a standard shipping carrier selected at our discretion. Shipping is free for all Product Store orders. A signature may be required upon delivery. Customers are responsible for ensuring that someone is available to accept delivery at the designated shipping address. We are not responsible for delays caused by carrier issues, weather, or other circumstances beyond our control.

7. Title and Risk of Loss

Title and risk of loss pass to you upon delivery of the products to the carrier at our facility, except that claims for shipping damage are governed by our Return Policy.

8. Returns

Products may be returned within thirty (30) days of shipment, subject to a 15% restocking fee. Products must be returned in original packaging and in perfect, like-new condition. These condition and restocking fee requirements do not apply to products that are damaged during shipping or defective. Products damaged during shipping must be reported within the 30-day return window for replacement under warranty. Defective products may be returned within the warranty period. 9. Warranty

All products sold through the Kaleidescape Product Store are new and covered by the Kaleidescape limited warranty as described in Section 8 of the SLA and the Warranty Period Policy available at https://www.kaleidescape.com/legal/warranty-period-policy/.

10. Limitation of Liability

The limitations of liability set forth in Section 8 of the SLA apply to purchases made through the Product Store.

11. Dispute Resolution and Governing Law

The dispute resolution and governing law provisions set forth in Sections 11(h) and 11(j) of the SLA apply to these Terms and any disputes arising from Product Store purchases.

12. Amendments

We may update these Terms at any time. The version in effect at the time of your order governs that transaction.
